Smallwood Archer Construction, Inc. and its subsidiary companies (collectively “Archer”) are committed to protecting the privacy of your information. This privacy policy applies to Personal Data obtained on or through digital services provided by Archer, which includes the Archer website found at https://archer-cdc.com/ and any other Archer online or mobile website, application or digital service (collectively “Digital Services”). 

“Personal Data” is defined as information relating to an identified or identifiable person. An identifiable person is a person who can be identified, directly or indirectly, in a particular reference to an identification number or one or more factors specific to the person. “Non-Personal Data” is defined as any information that does not result in the identification of a specific person. “Information” may be either Personal Data or Non-Personal Data.

By visiting or utilizing the Digital Services, you are accepting the policies described in this Privacy Policy and consenting to the collection and use of Information by Archer. You also consent to any action we take with respect to your Information in compliance with this Privacy Policy. 

INFORMATION COLLECTED 

The Information we collect when you contact us via the website may include Personal Data such as name, postal address, telephone number, fax number and email address, and certain business information such as your company’s name or job title.  We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website is not intended for children, nor do we knowingly collect information from children under the age of 13.  Our website, products and services are all directed to people who are at least 18 years old or older.

USE OF INFORMATION COLLECTED 

The Digital Services are hosted in the United States but may be accessed internationally as well. The Personal Data entered into this system is considered business contact information. We collect and use the Personal Data to: respond to your requests, make marketing and sales initiatives relevant to your needs, communicate product or service information, provide service and support, provide directions to our offices, communicate significant changes to the websites, or inform you of future thought-leading conferences, and other events. We also may use the information to better improve our Digital Services, to enable us to customize your experience on the sites and display relevant informational or promotional material. 

We may use the Personal Data to send you email and other communications on behalf of Archer. These communications may include email, newsletters, service offerings, and marketing event notices (for example: executive briefing and webinar notices). All email communications, newsletters and marketing event notifications will provide you with an opportunity to opt out of receiving future emails from Archer. 

SHARING OF INFORMATION COLLECTED 

We do not sell, trade, share or rent your Personal Data to third parties. Unless we have your permission or are required by law to do so, we will only share the Personal Data you provide to us with Archer entities and service providers who are acting on Archer’s behalf to complete the activities described above. Such Archer entities and service providers are governed by our Privacy Policy with respect to the use of Personal Data. 

COOKIES 

“Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. Archer’s cookies enable us to recognize that you are a returning visitor to our Digital Services. We may use cookies to record user-specific information concerning the pages you access or visit and to record past activity at the site to provide better service and experience to returning visitors.  

We may also use Information gained through cookies to compile statistical information about the use of our Digital Services, such as the time users spend at the site and the pages they visit most often. These statistics do not include Personal Data. 

STORAGE AND DATA SECURITY 

We maintain reasonable physical, electronic, and procedural safeguards to protect Personal Data from loss, misuse and unauthorized access, disclosure, alternation, and destruction. We host these Digital Services in a secure server environment that use firewalls and other advanced technology to prevent interference or access from outside intruders. Unfortunately, even with these measures, we cannot guarantee the security of the Personal Data. By using our Digital Services, you acknowledge and agree that we make no such guarantee, and that you use our Digital Services at your own risk. 

RETENTION 

Archer retains Information in accordance with the applicable corporate record schedule for as long as the Information is needed for the purposes for which it is collected, or for such longer period as may be legally required. The Information is then destroyed in accordance with corporate guidelines. You may contact us using one of the methods listed at the end of this Privacy Policy for additional details relating to our retention of Information. 

CALIFORNIA CONSUMER PRIVACY ACT (CCPA) 

If you are a California resident, you have the right to know about the personal information we collect and how it is used and shared, as described in this Privacy Policy. You may also have the right to require deletion or correction of personal information we collect. Further, you have the right to opt out of any sharing of your information with third parties. Should you wish to make a request, please contact us using one of the methods listed at the end of this Privacy Policy. You have the right to non-discrimination for exercising your CCPA rights. 

CHANGES TO THIS PRIVACY STATEMENT 

We reserve the right to change this Privacy Policy at any time by posting a new version on the Digital Services. The new version will be effective on the date posted which will be stated at the top of the page as the new effective date. 

ENFORCEMENT 

We use a self-assessment approach to ensure compliance with this Privacy Policy and periodically verify the policy is accurate and is comprehensive for the information intended to be covered, prominently displayed, and completely implemented. We encourage interested persons to raise concerns using the contact information provided at the bottom of this page, and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of Personal Data.
